1. Introduction
These Terms of Service (“Terms”) govern the use, access and subscriptions of the SMILEJI habit building Wellness App, the website, mobile applications, support services, in-app products, premium subscriptions, and any related offerings (collectively, the “Services”) by SMILEJI. Your use, access, or subscription to the Services above mentioned implies your explicit acceptance of these Terms, conditions and the laws in force at the concerned time
2. Definition of Service
Services means and includes the use, access and subscriptions of the SMILEJI wellness app, website, mobile application and support services and not limited to content and sessions conducted on the app, website and mobile application provided by the entire team of SMILEJI.
3. Scope of Service
Unless stated otherwise, your use of the Services is governed by these Terms. The Services are provided “as is,” with all faults,” and to the highest degree permitted by law. The services shall be made available for use, access and subscription at all times except when under maintenance or unforeseen technical challenges SMILEJI shall not be liable for any inaccuracy, delay, or loss of data, content, or personalization on the app or website that it is unaware of.

7. Others Merchandise on Sale
8. Offline Workshops or Programs

10. Weekly online Catchup/Refresher – Inner Circle Call
11. Customer Support
12. Notifications to Users/Subscribers
13. Other Party Adverts in the Banner – Static or Dynamic
14. Redeem gained Points
15. Updates as and when required
. Advertise or Offer External/Third Party Services in relation to the services provided by the app
4. Account Registration
You must be of legal age in your jurisdiction (typically 18+) to use the Services. Users under that age must have verified parental or guardian consent.
SMILEJI do not knowingly collect personal data from children under 13 (or under 16 year). If we become aware that a child has provided us personal data without parental consent, we will delete such data.
Creating an account (“Account”) allows you to access app features, manage subscriptions, track your progress, or make purchases. You're solely responsible for all activity under your account and safeguarding your login credentials. Report unauthorized access immediately.
SMILEJI reserves the right to suspend or terminate your account if the information you provide is false, outdated, or incomplete, without liability, though you may still be responsible for damages arising from unauthorized use.
SMILEJI may collect health related information from you to provide customized/personalized advice, recommendations, inputs and plan in accordance with the privacy policy, confidentiality and the applicable laws. By registering an account with the app or at the website you agree to provide such information.
5. Content & User Submissions
App Content: All materials (videos, text, graphics, tools) created by SMILEJI are owned or licensed by SMILEJI and are protected by intellectual property laws. You may access and use them for personal, non-commercial purposes only.
Your Contributions: You are responsible for any content you submit (“User Submission”). You warrant you own or are licensed to submit such content and grant SMILEJI a perpetual, royalty-free, transferable license to use, modify, publish, or adapt it.
Moderation: SMILEJI may, at its discretion, remove any content without notice. SMILEJI may also preserve and disclose content as required by law, to enforce Terms, or protect rights and safety.
Offensive/abusive/obscene content shall be immediately reported or flagged by the User to SMILEJI
Content on the app shall only be posted/uploaded by SMILEJI and SMILEJI does not endorse user generated content and is not responsible for the same.
SMILEJI follows a no strict data sale policy which the user have to abide with.
6. Acceptable Use & Restrictions
SMILEJI grants you a limited, non-exclusive, non-transferable license to access and use the Services solely for your personal, non-commercial wellness use.
You agree NOT to:
Copy, reproduce, alter or modify, distribute, or publicly display our content without explicit written consent.
Reverse-engineer or modify the app or its functionalities Circumvent security or content protections
Use automated tools to scrape or harvest data
Post spam, malicious content, or impersonate others
Upload harmful or illegal content
Use the Services unlawfully or in a way that harms others
Facilitate or endorse discriminatory, harassing, or offensive acts
Violate any applicable law or regulation
Use the platform to promote any unauthorized products or services.
7. Subscription, Credits & Payments
a. The Services in the app may include subscriptions or credit-based offerings.
b. The app offers auto-renewing and/or one-time subscriptions that unlock premium features.
c. Payments are charged to the User’s Google Play Store / Apple App Store account at the time of purchase.
d. Auto-renewing subscriptions will automatically renew unless turned off at least 24 hours before the current billing period ends.
e. Some subscriptions may include a free trial.
f. If the user does not cancel before the end of the trial period, user will be automatically billed for the full subscription fee.
g. Credits are non-refundable if used or expired per account details.
h. User is responsible for Cancelation of the subscriptions. Uninstallation of the app does not amount to cancellation of the subscription. Cancellation becomes effective at the end of your current billing cycle.
For Google Play Store:
Settings → Payments & Subscriptions → Subscriptions → Select App → Cancel Subscription
For Apple App Store:
Settings → [Your Name] → Subscriptions → Select App → Cancel Subscription
i. Payment Processing: Payments are handled by third-party processors and subject to their terms.
8. No Refund Policy
All subscription payments are final. No refunds are provided for:
Accidental purchases
Change of mind
Partial use of subscription
Unused time after cancellation
Incorrect assumptions about features
Forgetting to cancel auto-renewal
Once a payment is successfully processed, the amount cannot be reversed or refunded.
This policy applies to all payment methods supported by the App Store / Play Store
9. Exceptional Refund Situations
Refunds may only be provided in the following rare cases:
Duplicate payment charged by the App Store / Play Store
Fraudulent transactions or unauthorized purchases, subject to store investigation
Technical issues preventing app usage, and only after verified review by our support team
Billing errors caused by the app store
In such cases, refunds are not processed by:
Google Play Support
Apple App Store Support
10. Termination
SMILEJI may suspend or terminate your access to the Services, without notice, if:
You violate these Terms or applicable laws.
We discontinue or change parts of our Services.
SMILEJI may modify or terminate any Service feature at any time. Breaches of these Terms may result in immediate suspension or termination of your access, without liability. Post-termination, all rights granted to you will cease to exist and SMILEJI is not obligated to retain or return your data including user contribution. Clauses in this terms and conditions pertaining to confidentiality, Indemnity, Limitation of Liability, and Intellectual Property survive termination.
11. Consequences of breach of terms
Any user or subscriber who violates, breaches, or attempts to circumvent any provision under this terms and conditions, including but not limited to unauthorized access, abusive behavior, unauthorized sharing of accounts, attempting to hack or manipulate the platform, misuse of services, sharing login credentials, distributing restricted and confidential content, violating confidentiality clause, or engaging in fraudulent/illegal activities shall be liable to pay penalties and face necessary legal actions taken by SMILEJI.
SMILEJI reserves the right to impose:
A monetary penalty for the breach which shall be communicated through a legal notice
Actual damages incurred, whichever is higher.
In addition, the SMILEJI may take any of the following actions, at its sole discretion:
Immediate suspension or permanent termination/deletion of the user’s account
Revocation of access to all paid features without refund
Legal action to recover damages, costs, and expenses (including attorney fees)
Reporting fraudulent activity to relevant authorities or app store platforms
All penalties and damages become due immediately upon written notice to the user and must be paid within 7 working days.
Failure to pay the penalty within the specified period may result in:
Additional interest at 18% per annum on the outstanding amount, and
Initiation of necessary legal recovery proceedings.
Imposition of penalties does not limit or restrict SMILEJI’s right to claim additional damages as allowed under law.
12. External Links
The Services may contain links to third-party sites, content or services. SMILEJI is not responsible for third-party content, policies, practices or liabilities. Access external resources at your own risk.
13. Intellectual Property & Licensing
All content on the SMILEJI app (including videos, audio, designs, trademarks, and materials) is owned or licensed by us and the brand SMILEJI is protected by intellectual property laws. You may view or stream the content for personal use but may not download, modify, or distribute it for any commercial use without explicit permission from the brand.
User-submitted content such as feedback, comments, or testimonials may be used by SMILEJI for promotional or improvement purposes. By submitting such content, you grant us a non-exclusive, royalty-free license to use it across media.
SMILEJI Content: All rights, including trademarks and copyrights, remain with SMILEJI or its licensors. Unauthorized use is strictly prohibited.
Use Restriction: You may view/apply content for personal wellness use only—no reproduction or distribution without explicit written permission.
User Submissions: While you retain ownership, you grant SMILEJI a broad license to utilize derivative works indefinitely.
14. Warranty Disclaimer
Your use of the Services is at your own risk. All content and services are provided “as is” and “as available” without any warranties, express or implied. SMILEJI disclaims any warranties, express or implied, including those of merchantability or fitness for a particular purpose. No guarantee or warranty exists that Services will be uninterrupted, secure, or error-free information and performance.
15. Limitation of Liability
To the fullest extent permitted by law, SMILEJI and its team disclaims liability for:
Errors, outages, or interruptions in service.
Loss or corruption of data.
Unauthorized access to your account or personal data.
Health issues resulting from the use of our content.
To the fullest extent allowed by law, SMILEJI and its associates are not liable for any direct or indirect damages arising from your use of the Services. The content and services provided on the app is for information purpose only. User are advised to seek necessary and appropriate medical diagnosis from a medical practitioner where required.
16. Confidentiality
The data/information collected by the app or website of the users shall be treated as confidential information and shall not be disclosed under any circumstance. In the same manner information about SMILEJI which is not in public domain regarding its business model/strategies disclosed to any user whether written, Oral or in electronic format shall be considered as confidential information.
For the purpose of this terms and conditions, “Confidential Information” refers to any data, material, content, documentation, or information, whether oral, written, digital, or otherwise, that is disclosed by one party (“Disclosing Party”) to the other (“Receiving Party”), including but not limited to:
User data and personal information
Business processes, documents, pricing, internal methods
Technical data, source code, algorithms, or product plans
Marketing strategies, financial information, or proprietary insights
Any information marked “confidential” or that should reasonably be understood as confidential
These confidentiality obligations survive the termination, expiration, or use of the Services of the app.
17. Indemnification
You agree to indemnify, defend, and hold harmless SMILEJI, its team, affiliates, representatives and partners from any claims liability, loss, or expense (including legal fees) arising out of or from your breach of these Terms or misuse of the Services
18. Privacy Policy
SMILEJI gives utmost importance to the privacy of its users. Data protection and Privacy is the highest priority. Personal information of the users is collected and protected only for the purposes of rendering the required services in the app and website. No personal information or data is disclosed and revealed to any third party unless in furtherance of the service to be rendered.
SMILEJI collects data with respect to device attributes, devise operations, device signals, data from device settings and cookie data to identify potential fraud and security purposes.
Users may have to provide sensitive and personal information to the app to provide accurate services. Providing such information shall mean explicit consent given by the User to access and utilize such information.
Cookie management shall be governed by DPDP act
SMILJI shall also have the liberty to access behavioral usage Data such as
Actions taken by the users such as likes, shares, comments and the like
Content viewed, frequency and time
Link interactions
Inferences drawn from behavior
SMILJI is aware and acknowledges the privacy of its users and subscribers in adherence to the Digital Personal Data Protection Act, 2023 in order to ensure the data is collected, processed and utilized responsibly. The data/information collected will be utilized lawfully by SMILEJI. Data collected from users outside India shall be utilized and stored lawfully.
19. Governing Law & Dispute Resolution
Any dispute which may arise between SMILEJI and the user shall be first be dealt with in an amicable manner. In the event the dispute cannot be resolved through amicable means, the same shall be referred to arbitration governed by the Arbitration and conciliation act,1996. The seat of arbitration shall be Delhi. These Terms are governed by the laws of the Republic of India, with exclusive jurisdiction in the courts of Delhi, India. Any dispute must be filed within 3 months from the event giving rise to the claim.
20. Modifications to Terms
These Terms apply to all users (“you” or “User”). SMILEJI may issue additional Supplemental Terms for specific Services (e.g., premium offerings or community features); in case of conflict, the Supplemental Terms govern.
SMILEJI reserves the right and may update these Terms at any time. We will notify you of major changes via app or email. Continued use of Services after modifications means you accept the changes. If you disagree, please stop using the Services.
21. General Provisions
These Terms, together with the Privacy Policy, form the entire agreement.
Unenforceable provisions will not affect the remainder.
No waiver of a right is effective without written confirmation.
You may not assign your rights; SMILEJI can assign these Terms freely.
SMILEJI explicitly disclaims third-party beneficiary rights.
22. Health Disclaimer
SMILEJI offers content and tools for relaxation, wellness, mindfulness, and self-improvement. However:
We do not offer medical advice.
Our content is not intended to replace professional health or mental health services.
Please consult your physician or mental health provider before making changes to your health routine.
23. User Agreement Acknowledgment
By downloading, registering, accessing, or using the smileji App and its related services, you acknowledge that you have read, understood, and expressly agree to be bound by the following legal agreements:
1. Terms & Conditions of Use – governing your responsibilities, usage rights, restrictions, and the app’s general rules of operation.
2. Privacy Policy – explaining how we collect, store, process, and protect your personal and health-related data in compliance with applicable data protection laws (including GDPR).
3. Disclaimer – clarifying that our content is for informational and self-help purposes only and is not intended as a substitute for professional medical or psychological advice.
4. Subscription Terms – outlining billing practices, renewal conditions, cancellation procedures, and refund policies for PREMIUM or any premium services.
5. Community Guidelines & Content Policies – governing user-generated content, interactions, and behavioral standards within the smileji app.
Continued use of this app signifies your legally binding agreement to all of the above. If you do not agree, you must not use or access any part of the smileji App.
By using SMILEJI, you confirm that you’re legally bound by these Terms.
24. Changes to Policy
SMILEJI reserves the right to update or modify this Subscription & Refund Policy at any time. Any changes will be effective immediately upon posting within the app or our website.
